Great question, and it’s an important question because a lot of people think they can just have someone read and sign-off on their policy, or park them in the conference room and hit play on a video and call it training. But the NYS DOL has been very clear that this is a big no no and does not meet the requirement for interactive training.
So what DOES interactive training include?
Well the DOL gives 3 responses. And of note, your training does not have to hit all of this elements, but it must hit 1 of the 3. The goal is that you the employer should be getting some level of feedback from those being trained so…
1. Training should ask questions of the employees as part of the training
This could be using a quiz sheet, a group discussion, or an online polling questionnaire that makes the employee provide some feedback. Again, you are looking for some engagement.
2. Training should accommodate questions asked by employees, with answers provided in a timely manner
So this could mean that you have a live trainer answering the questions, or you have a question portal that allows a trainer to respond in a reasonable amount of time.
And, when we asked our lawyers to help us define that term “reasonable” we got the response that within 48 hours should be a safe response time.
And finally,
3. Training should require feedback from the employees about the training and materials presented.
So this, again, could be a final test after the training to confirm learning. Maybe the employee has to come and have a conversation with the trainer when complete to review any questions, or to conduct an oral exam, anything that makes it so the attendee is not just a passive participant.
So what are some examples of interactive training?
It could be a group training with a proctor leading discussion, it could be an online webinar where employees can ask questions or answer polling questions, it could be something that employees take on their computer or smartphone, as long as it hits one of those three elements that I just mentioned earlier.
